These Terms and Conditions apply when you purchase products, book services, accept a quote, or otherwise engage Airmax Installations Ltd through airmax-install.co.nz, by email, by telephone, or in person.
1. About Airmax
“Airmax”, “we”, “us”, “our” and “Contractor” mean Airmax Installations Ltd, including its authorised employees, subcontractors, successors and assigns.
“Customer”, “Client”, “you” and “your” mean the person, company or entity purchasing products or receiving services.

You accept these terms by placing an online order, booking a service, accepting a quote, authorising a variation, or permitting work to begin.
These terms apply together with the relevant product description, accepted quote, order confirmation and invoice. If a specific written quote expressly conflicts with these general terms, the specific written term in the quote takes priority for that job.
You must promptly tell Airmax about any change in ownership, contact details, delivery information or site circumstances that may affect an order or the work.
3. New Zealand consumer rights
Nothing in these terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, including rights under the Consumer Guarantees Act 1993 and Fair Trading Act 1986.
Products and services supplied for personal or household use carry the guarantees and remedies required by New Zealand law. Manufacturer and workmanship warranties are additional to those rights.
4. Products, services and pricing
All online-shop prices are in New Zealand dollars and include GST.
Quotes and invoices will state whether their figures include or exclude GST. GST is charged at the applicable New Zealand rate.
A heat-pump equipment price covers only the equipment described on the product page unless installation is expressly included. Installation, electrical work, pipework, mounting materials, penetrations, access equipment, disposal and other site work are separate unless expressly included in the product description or accepted quote.
Service products cover only the work described on the product page or booking confirmation. Additional parts, repairs or labour require customer approval, except for reasonable work immediately required to make a dangerous situation safe.
Product images are illustrative. Minor appearance, packaging or specification changes may occur, but Airmax will not knowingly substitute a materially different model without your approval.
5. Equipment selection and sizing
Room-size guides and product recommendations are general guidance only. Suitable capacity depends on matters including insulation, glazing, ceiling height, room orientation, occupancy, local climate and the property’s construction.
Airmax recommends a professional assessment before installation. If you purchase equipment without an Airmax assessment, you are responsible for confirming that the equipment is suitable for the intended property and purpose.
6. Orders, availability and acceptance
Submitting an order is an offer to purchase. An automated acknowledgement confirms receipt but does not guarantee stock availability or final acceptance.
An order is accepted when Airmax confirms fulfilment, dispatch or the relevant service booking.
If a product is unavailable, materially misdescribed or affected by an obvious pricing error, Airmax may contact you with an alternative or cancel the affected order and promptly refund the amount paid. Airmax will not substitute another model without your approval.
7. Payment
Products purchased through the online shop must be paid in full using a payment method offered at checkout.
Unless an accepted quote or invoice states otherwise, quoted installation work requires a 50% deposit before equipment is ordered or work begins, with the remaining balance payable on completion.
Card payments are processed through WooPayments or its payment partners. Airmax does not receive or store your complete card number.
An overdue amount may incur interest at 2.5% per month, calculated from the payment due date until payment. The customer may also be responsible for reasonable collection costs actually incurred and recoverable by law. These provisions do not restrict any consumer right or right to dispute an invoice in good faith.
8. Free nationwide delivery
Eligible Samsung equipment purchased through the Airmax online shop includes delivery to a New Zealand delivery address at no additional charge.
Airmax arranges delivery through our fulfilment partners. Estimated delivery is 3–14 business days from your order, including order processing and transit.
You must provide an accurate street address, contact telephone number and any information reasonably required to complete delivery. Airmax may contact you where an incorrect address, access restriction or circumstance outside normal delivery arrangements prevents delivery.
Delivery dates are estimates unless Airmax expressly agrees to a fixed date in writing. Airmax remains your point of contact and is responsible for assisting with deliveries that are delayed, lost, incorrect or damaged.
Please inspect delivered goods as soon as reasonably practicable and promptly tell Airmax about visible damage, missing items or an incorrect product. Delayed reporting does not remove any rights you have under New Zealand law.
Services, digital items and quote-only products do not attract a delivery charge.
9. Risk and title
For consumer deliveries arranged by Airmax, responsibility for the equipment passes to the customer when delivery is completed at the agreed address, subject to applicable law.
Ownership remains with Airmax until full payment has been received. Where legally permitted and payment remains overdue, Airmax may recover equipment that remains identifiable and removable without unlawful entry or unreasonable property damage.
10. Installation requirements
Unless expressly included in the product description or accepted quote, equipment purchased online does not include installation.
Heat-pump and HVAC equipment must be installed and commissioned by appropriately qualified people in accordance with applicable laws, manufacturer requirements and warranty conditions.
Airmax is not responsible for faults caused by unauthorised installation, misuse, failure to follow operating instructions or alterations by another person. This does not limit Airmax’s responsibility for products and services supplied by Airmax.
11. Variations and unforeseen conditions
Requested variations should be recorded in writing.
Additional charges may apply where concealed damage, outdated components, unsuitable wiring, structural issues, asbestos, restricted access or other conditions could not reasonably have been identified before work began.
Where reasonably practicable, Airmax will explain the issue and obtain approval before additional chargeable work is performed.
A minor variation reasonably necessary to complete the agreed work, and costing less than 2% of the contract value, may be completed without formal prior approval where stopping would be impractical or could create an unsafe or incomplete result. Airmax will explain the variation and charge afterward. This does not permit unrelated or unnecessary work.
12. Site access and safety
You must provide:
- safe and reasonable access at the agreed time;
- a clean work area and protection or removal of fragile and valuable items;
- reasonable access to electricity and water where required;
- accurate information about known hazards, asbestos, hidden services and property defects; and
- any owner, landlord, body-corporate or other authority needed for the work.
Airmax may pause, refuse or reschedule work where continuing would be unsafe, unlawful or likely to cause damage.
Airmax is not responsible for damage to items that the customer was reasonably asked to move or protect, but this does not exclude liability for damage caused by Airmax’s failure to exercise reasonable care and skill.
13. Consents and compliance
Unless the accepted quote states that Airmax will arrange them, the customer is responsible for obtaining required building, landlord, body-corporate or council approvals.
Airmax will perform its work in accordance with applicable New Zealand requirements, including relevant building, electrical, refrigerant and health-and-safety obligations.
14. Completion and delays
Airmax will begin and complete work within the agreed timeframe or, where no timeframe is agreed, within a reasonable time, subject to material availability, site readiness and events outside Airmax’s reasonable control.
Work is considered complete when the quoted system or service has been installed, serviced, commissioned or otherwise completed in accordance with the agreed scope, apart from minor matters that do not prevent reasonable use.
Customer-caused delays or requested changes may extend the completion date and may result in reasonable additional costs disclosed to the customer.
15. Appointments and cancellations
Please tell Airmax as soon as possible if an appointment must be changed.
Any cancellation or call-out fee must be disclosed before the booking is completed or separately agreed. Airmax may reschedule work because of unsafe conditions, staff illness, severe weather, product delays or circumstances reasonably outside its control.
If Airmax cannot provide a prepaid service within a reasonable time, you may request another suitable date or a refund for the unperformed service, subject to applicable law.
16. Change-of-mind returns
Airmax is not required to provide a refund merely because a customer changes their mind.
Airmax may agree to accept an unopened, unused standard product for return. Approval may depend on its condition, packaging, dispatch status and any reasonable supplier restocking cost disclosed to the customer.
Special-order, installed, commissioned, used or customer-damaged products cannot normally be returned for change of mind.
These conditions do not apply where you are entitled to a remedy under the Consumer Guarantees Act or other applicable law. Contact Airmax before returning anything. Do not return products to a fulfilment partner or carrier unless Airmax instructs you to do so in writing.
17. Faults, damage and remedies
If a product or service does not meet an applicable consumer guarantee, the remedy depends on the nature and seriousness of the problem.
For a minor problem, Airmax may repair the product, replace it or provide a refund as permitted by law. For a substantial failure, the customer may reject the product, cancel the affected service or choose another remedy available under law.
Airmax will cover reasonable return or collection costs where legally required because a supplied product is faulty, incorrect or damaged in transit.
18. Warranty
Unless otherwise specified in writing, Airmax workmanship and materials supplied as part of Airmax’s work carry a 12-month warranty from completion.
Manufacturer warranties also apply to eligible HVAC equipment. Warranty coverage may require reasonable maintenance and compliance with manufacturer operating and servicing requirements.
Warranty coverage does not apply to problems caused by customer misuse, unauthorised alteration, poor site conditions not created by Airmax, or customer-supplied equipment. Nothing in this clause limits rights under the Consumer Guarantees Act.
19. Suspension, default and termination
Airmax may suspend work or withhold further supply where an undisputed payment is overdue, the customer materially breaches these terms, or continuing would be unsafe or unlawful.
Where applicable, suspension for non-payment will comply with the Construction Contracts Act 2002.
Airmax may terminate the contract after giving reasonable notice if a material breach is not remedied within a reasonable time. The customer remains responsible for work properly completed, non-cancellable materials reasonably ordered and other amounts lawfully owing up to termination.
A customer may terminate where an unforeseen delay or cost increase exceeds 15% of the original contract value, excluding customer-requested or separately approved variations, subject to payment for work properly completed and applicable consumer rights.
20. Insurance and subcontractors
Airmax maintains public liability insurance of no less than NZ$1,000,000.
Customers should maintain appropriate insurance for their property and contents.
Airmax may use appropriately qualified subcontractors to perform parts of the work. Airmax remains responsible for work it is legally responsible for and for managing subcontracted work within the agreed scope.
21. Liability
Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for reasonably foreseeable loss recoverable under the Consumer Guarantees Act.
To the extent permitted by law, Airmax is not responsible for loss caused by inaccurate customer information, unauthorised installation, customer misuse, work performed by another contractor or failure to follow reasonable instructions.
22. Business purchases
Where products or services are acquired in trade, both parties are in trade, the agreement is in writing, and it is fair and reasonable, the parties may expressly agree that specified provisions of the Consumer Guarantees Act 1993 or Fair Trading Act 1986 will not apply.
This clause does not apply to ordinary consumer purchases and does not by itself remove any statutory right.
23. Personal information
Airmax uses customer information to process payments, fulfil orders, arrange delivery, provide services, communicate about the order, maintain business records and meet legal obligations.
Information may be shared with fulfilment partners, delivery providers, payment providers and other service providers where reasonably necessary for those purposes. Further information is provided in the Airmax Privacy Policy.
24. Website information
Airmax takes reasonable care to keep product descriptions, availability and pricing accurate. Availability may change before an order is accepted.
Website content is general information and does not replace a property assessment, professional design, installation advice or safety advice.
25. Events outside reasonable control
Neither party will be treated as breaching these terms because of delay caused by an event reasonably outside its control, provided reasonable steps are taken to reduce the effect and affected parties are kept informed.
This clause does not remove rights relating to unreasonable delay, cancellation, refunds or delivery under New Zealand law.
26. Complaints and disputes
Please contact Airmax first so we can try to resolve your concern promptly:
Email: info@airmax-install.co.nzPhone: 021 051 2558
If a consumer dispute cannot be resolved directly, you may seek independent advice or use the Disputes Tribunal or another remedy available under New Zealand law.
27. Changes and governing law
Airmax may update these terms for future orders. A change does not retrospectively alter an order or quote already accepted unless both parties agree or the law requires it.
These terms are governed by New Zealand law. New Zealand courts and tribunals have non-exclusive jurisdiction.
